Code on Wages: Structural Salary Impact

The statutory wage definition forces basic pay to be at least 50% of total remuneration — with knock-on effects on PF, gratuity and take-home.

The Code on Wages introduces a single definition of 'wages' applicable across minimum wages, payment of wages, bonus and social security contributions. Excluded allowances cannot exceed 50% of total remuneration; anything beyond that is added back to wages.

For most employers with allowance-heavy structures, this means a higher PF wage base, higher gratuity accrual and a lower net take-home unless the CTC is restructured. Employers should model at least three scenarios before implementation: current structure, compliant structure at same CTC, and compliant structure at same take-home.

Practical next steps: rebuild the salary master, recompute statutory liabilities, update appointment letters and communicate the change to employees with a clear before-and-after illustration.
